South Dakota Governor Kristi Noem is taking a stand against President Joe Biden’s proposed changes to Title IX rules. The changes would prevent colleges and high schools from prohibiting biological men who are transgender from competing against women in athletic sports.

Governor Noem responded on Twitter, stating that “South Dakota will not allow this to stand. We will lead. We will defend our laws. Only girls will play girls’ sports. President Biden, we’ll see you in Court.”

The proposed regulations seek to clarify Title IX’s application to sex-related criteria that limit or deny a student’s eligibility to participate on a male or female athletic team consistent with their gender identity.

The U.S. Department of Education aims to ensure equal opportunity in athletics and provide clarity for students, parents, and coaches. The proposal seeks to establish that policies that categorically ban transgender students from participating on sports teams consistent with their gender identity violate Title IX.

Noem has previously signed legislation called the “Help Not Harm” bill, which prevents some surgical and medical procedures for transgender minors.

The legislation was introduced in January by state Republicans that prevent minors from getting puberty-blocking drugs, hormone therapies, and surgeries that assist the minor in changing their gender appearance.
